1. Helmets must be worn by hitters while in the cages.
2. Anyone throwing batting practice and/or pitching to batters must throw from behind a protective screen.
3. Only one hitter and a maximum of two people are allowed in the cage at any time.
4. Do not pull or hang on any of the netting.
5. Do not throw balls or swing bats outside the batting cages.
6. Do not attempt to open, fix, or move any pitching machine. Ask staff or a coach for assistance adjusting speed/height.
7. Only authorized coaches are allowed to access the equipment storage cage.
8. No profanity, fighting, or arguing.
9. Cleats can be changed into on turf, only; otherwise only turf shoes or tennis shows are allowed.
10. No sunflower seeds or food on the turf.
11. Do not enter Field Nine when under the influence of alcohol or drugs.
12. Respect the facility and clean up after yourself.
13. Field Nine is not responsible for lost or stolen items.

WAIVER, RELEASE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT (“Waiver)

In consideration of being granted entry to Field Nine, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against Field Nine, and all of its agents, sponsors and their representatives, volunteers and employees for any and all damages or injuries to me or my personal property. This release includes all damages and/or injuries suffered by me during or after entry to Field Nine premises. I recognize, intend and understand that this Waiver is binding on my heirs, executors, administrators and assignees.

1. I agree to follow the rules of Field Nine, stated above. I acknowledge that sports of all kinds, including but not limited to: baseball, softball and soccer are potentially hazardous and involve  known and unanticipated risks which could result in serious injury including permanent disability, death, and property damage. Hazards can result in, but are not limited to: broken bones, torn ligaments, bruises, and other bodily injuries as serious as blindness, disability and death caused by contact with baseballs, softballs, bats, other participants, or structures like walls or fences, or caused by uneven ground; medical conditions resulting from athletic activity; and damaged clothing or other property. I understand such risks simply cannot be eliminated despite the use of care and safety equipment and are inherently accepted by me.
2. I submit that if I bring equipment into Field Nine, I take full responsibility for the soundness of its fitness and consequences from using such equipment.
3. I understand that employees and agents of Field Nine  do not always staff the Field Nine premises however it may be accessible to me and my Team representatives at designated booking times.
4. I should not enter Field Nine unless I am medically able to do so and properly trained. I assume all risks including, but not limited to: falls, collisions or contact with other participants, sporting equipment and the effects of athletic activity on my body, and waive any and all claims which I might have based on any of those and other risks typically found in entry in an athletic training facility. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any agent of Field Nine relative to my ability to safely enter the facility and/or participate in athletic training. I certify as a material condition to my being permitted to enter Field Nine that I am physically fit and sufficiently trained for athletic activities in which I participate and that a licensed Medical Doctor has verified my physical condition.
5. In the event of an illness, injury or medical emergency, I hereby authorize and give my consent to Field Nine to secure from any accredited hospital, clinic and/or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization. Field Nine is often accessible by me or my Team representatives without agents of Field Nine on-site. The authorizations I have given in this Section apply to anyone who may procure medical assistance in any event they deem warranted.
6. As it applies to my entry to Field Nine, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the State, the community or by Field Nine.
7. Further, I grant permission to Field Nine to use my name, voice and images of myself in any photographs, videos, results, publications or any other print, video-graphic or electronic recording.
8. All booking fees are non-refundable. We reserve the right to postpone or cancel bookings due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. Refunds will be issued under these circumstances.
9. Should Field Nine or anyone acting on their behalf be required to incur attorneys’ fees and costs to enforce this Waiver, I agree to indemnify and hold them harmless for all such fees and costs.
10. I represent that I have adequate insurance to cover any injury or damage I may suffer, or else I agree to bear the costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with my safety, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.
11. In the event that I file a lawsuit, I agree to do so solely in Vigo County and in the State of Indiana where Field Nine is located; and, I further agree that the substantive law of the State shall apply.
12. I agree that if any portion of this Waiver is found to be void or unenforceable, the remaining portions shall remain in full force and effect. By signing this Waiver, I agree that if I am hurt or my property is damaged, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being released based on any claim, including negligence.
13. Field Nine is not responsible for lost or stolen items or damages to personal property.

I acknowledge (a parent or adult guardian for all children under 18 years) having read and agreed to this Waiver.
